NHS England is primarily a commissioning body. The CQC is an inspectorate. NHS England however has the role of commissioning investigations. It is therefore neither helpful nor honest for NHS England to take the stance that it does not conduct investigations and therefore cannot call one into being. NHS England routinely commissions under its commissioning framework at least 40 - 50 independent investigations each year under the HSG (94) 27 guidance (for homicide and suicide incidents involving mental health service users). The current arguments are disingenuous and NHS England can, and should, add to its current commissioning role under the framework that it already has in place.
